GENERAL TERMS AND CONDITIONS OF CONTRACT

The following General Conditions of Contract, hereinafter the "Conditions" regulate the contractual relationship between the company HISPA IMPORTACIONES DELUXE S.L. with C.I.F B57779423 and with fiscal address at Calle Duque de Sesto 13, 28009, Madrid (Spain) and the user who purchases products and/or services through the website www.espiamos.com property of HISPA IMPORTACIONES DELUXE S.L.U (hereinafter, The Company).

General Conditions of Contract

HISPA informs that the following terms and conditions are also permanently available to the user on the aforementioned website. We recommend reading this document, downloading it and printing it out for safekeeping.

 

I.- General Aspects.

The general conditions are written in Spanish and are basically governed, among others, by Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce and, where appropriate, by Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws.

 

General conditions.

Only persons over 18 years of age may contract in their own name and right or, where appropriate, in that of the legal person with legal representation. By accepting these terms and conditions you declare that you are of legal age.

 

II.- Object.

The purpose of this contract is the online procurement of products and services through the website www.espiamos.com intended solely for professionals in the private investigation sector and individuals for business and parental control. 

Not every user who contracts through the website www.espiamos.com is considered a consumer. For these purposes consumers shall be understood to mean only natural persons acting for purposes outside their trade, business, craft or profession and legal persons and unincorporated entities acting for non-profit purposes outside a trade or business activity.

The carrying out of electronic commerce through the website www.espiamos.com implies the acceptance of these general terms and conditions of contract.

The company expressly prohibits the purchase and acquisition of any of the products for the commission of actions that could constitute a civil offence and/or crime. The company shall not be liable for the improper use of the products purchased on www.espiamos.com or for any intrusion into the privacy or secrecy of communications that may be carried out.

 

III.- Ordering.

Orders can be placed online via the website or by telephone or email.

Orders are processed Monday to Friday from 9:00 am to 4:00 pm. Orders placed on Fridays after 16:00 h will be processed on the next working day.

For the contracting of any of the products and/or services offered, the user can buy directly by clicking on the icon of the products of interest. Once included in the basket, you can continue shopping using the same process.

Once the selection of products is complete, the process of formalising the purchase will proceed through which the user must fill in the personal data form for our registration as a customer and enable the delivery of your order. Registration as a customer means that the personal data are registered so that in subsequent purchases it will not be necessary to fill them in again.

After validating your order automatically and after express acceptance of these conditions and the Privacy Policy you will receive an email confirming that your order has been registered.

HISPA informs you that it will file the electronic document in which your order is formalised. Likewise, the contractual information will be provided to you prior to receipt of the products purchased so that, if necessary, you can correct any erroneous data appearing on your order. Likewise, the company informs you that once the order has been placed and sent, you will not be able to modify your purchase without prejudice to the exercise of the right of withdrawal.

The invoice will be sent to you in paper format together with your order at the time of delivery.

 

IV.- Prices and Payment Methods.

The prices of the products and/or services indicated on the website all include Value Added Tax.

The promotions and discounts listed on the website are exclusive to sales made online. Prices in the physical shops may vary.

Shipping costs will be free if the purchase is over 60 euros (VAT not included).

The company reserves the right to modify the price of the products at any time. However, the products will be invoiced on the basis of the rates in force at the time of registration of orders (subject to stocks remaining).

All payments shall be made in Euros using any of the payment methods.

The payment methods will be by cash on delivery and bank card (Visa, Visa Electron Master Card or credit and/or debit card, using a secure payment gateway on a secure server using the SSL (Secure Socket Layer) protocol by bank transfer. Please see additional costs for cash on delivery payment in the following section.

In all cases, the customer guarantees that he/she is authorised to use the payment card.

Secure Sockets Layer (SSL) technology is an SSL encryption tool that protects our website and all transactions that can be made through it securely. 

 

 

V.- Costs and Delivery Service.

The package will be delivered to the address designated at the time of the order or, if applicable, to the carrier's franchise or to the post office closest to the address, depending on the company in charge of delivery, if requested by the user.

Delivery costs and service.

Delivery costs shall be borne by the user in accordance with the rates indicated below. 

Items in stock will be processed and shipped within 24 business hours from the time of receipt of payment.

On receipt of your order you should check the packaging for damage. If this is the case, you must notify the carrier within a maximum period of 24 hours so that they can take responsibility for the damage. Deliveries are not insured. If you wish to take out damage insurance, you should contact Hispa beforehand for a quote.

VI.- Returns and Warranty Policy.

HISPA IMPORTACIONES DELUXE informs that in order to proceed with the return of products purchased through the website www.espiamos.com it is important to take into account the following considerations:

1º.- It is ESSENTIAL that the user keeps the original packaging, the invoice of the product and that the product is in perfect condition.

2º.- No changes will be accepted in the products nor will the amount be refunded with signs of use, incomplete or manipulated. The use that is allowed for the acceptance of a return is the mere verification of the condition of the device and the operation of the same.

3º - Under no circumstances will a package sent to our warehouse be accepted carriage forward. It is advisable to send by registered letter and insuring the goods to avoid damage and loss.

5º.-It is absolutely obligatory to present the proof of purchase for returns and for warranty procedures.

6º.- Before proceeding with any shipment contact HISPA IMPORTACIONES DELUXE through the Customer Service Center by calling +34 911 574 581 or contacting through this form so that we can give you the corresponding instructions.

  • Instructions for repairing products under warranty:

Repairs and replacements shall be free of charge to the consumer or user provided that the product is under warranty and the problem is proven to be due to a fault in the original manufacture. This free of charge shall include the necessary costs incurred to remedy the non-conformity of the products with the contract, such as shipping costs, labour and material costs only when the customer is a final consumer.

The company informs that when the purchase is made by companies and/or professionals for the development of their activity the guarantee of the products marketed on the website www.espiamos.com will be subject to the maximum period of 6 months from the delivery of the product without prejudice to the provisions applicable by the Commercial Code and Civil Code.

Only in the event that the user is a consumer. The company will be liable for the lack of conformity of the products marketed through www.espiamos.com during the period of 2 years from the delivery of the product in the terms established in the Royal Decree 1/2007 approving the revised text of the General Law for the Defence of Consumers and Users and other complementary laws. If the lack of conformity is manifested by the consumer 6 months after delivery, it shall be the responsibility of the consumer to prove that the lack of conformity already existed at the time of purchase of the product.

In no case shall the warranty be applicable if the lack of conformity has its origin in defects and/or deterioration caused by force majeure and/or installation and/or use not in accordance with the instructions for use and maintenance of the product.

The Technical Service will send you a R.M.A. which must be delivered together with the product signed by the customer. Once the goods have been received in our warehouses, and after checking the condition of the same, the company will check it and analyse whether the product is covered by the warranty.   In the event that the product has a malfunctioning problem covered by the warranty, HISPA IMPORTACIONES will proceed to exchange it for another product of equal or greater value. In the event that the product is out of stock, a product of similar or superior characteristics will be offered if the customer so wishes, paying the difference in price with respect to the higher value.

In the event that return of the product is due to any other cause the amount of the return will be deducted all costs that have occurred to send the product (courier service, cash on delivery) as well as 5% for management costs (commission for transfer or return by TPV)

 

Withdrawal:

The return of products purchased through the website www.espiamos.com as well as, where appropriate, the right of withdrawal regarding the purchase of products on the website www.espiamos.com will only be granted in the event that the buyer has the status of consumer and provided that the nature of the good purchased allows it.

In accordance with RDL 1/2007, of 27 March, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, the consumer may withdraw within 14 calendar days from receipt of the product in accordance with the provisions of the following paragraph. Depending on the case, the company reserves the right to issue a voucher for the same amount to be redeemed on our website. This voucher will not have an expiry date.

In the event that the consumer exercises the right of withdrawal in accordance with these conditions and consumer regulations, HISPA IMPORTACIONES DELUXE will refund the amount of the purchase in the same way in which it was paid and in the maximum period of 14 days from receipt of the product.

HISPA IMPORTACIONES DELUXE informs that all costs and risks associated with the return of products shall be borne by the user / consumer in accordance with Article 108 of Royal Legislative Decree 1/2007 of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws.

Without prejudice to the foregoing, HISPA IMPORTACIONES DELUXE informs you that in any case the exercise of the Right of Withdrawal is excepted in the following cases:

  • Contracts for the supply of sound or video recordings, discs and software which have been unsealed by the consumer and user after delivery, as well as computer files, supplied by electronic means, capable of being downloaded or reproduced immediately for permanent use.
  • The supply of digital content which is not provided on a tangible medium when the performance has begun with the prior express consent of the consumer and user with the knowledge on his part that he consequently loses the right of withdrawal
  • Any type of software
  • Products that have been tampered with or customised.
  • Any products that have been tampered with or customised.

 

 

Three-Year Warranty Policy.

The company informs that when the purchase is made by businesses and/or professionals for the development of their activity, the warranty of the products marketed on the website www.espiamos.com will be subject to a maximum term of 6 months from the delivery of the product, without prejudice to the provisions applicable by the Commercial Code and Civil Code.

From 11 July 2024, a three-year warranty is offered for the products purchased via the ESPIAMOS.COM website. This warranty applies only to those who hold the status of final consumer.

In accordance with the terms established in Royal Decree 1/2007, which approves the consolidated text of the General Law for the Defence of Consumers and Users and other complementary laws, the company will respond to the lack of conformity that manifest within a period of three years from the delivery of the product. If six months after the delivery of the product, the consumer manifests a lack of conformity, it will be their responsibility to prove that such a fault already existed at the time of the purchase of the product.

It is important to emphasise that the warranty will not apply in the following circumstances:

  • When the lack of conformity originates from defects and/or deteriorations caused by force majeure.
  • In case of installation and/or use of the product not in accordance with the provided use and maintenance instructions.
  • The warranty does not include the batteries of the products.

This three-year warranty reflects our commitment to the quality of our products and the service we provide to our customers.

 

VII.- Applicable legislation.

Any dispute that may arise from the use of this website, the parties submit to the Jurisdiction and Jurisdiction of the Courts and Tribunals of Alicante city, waiving their own jurisdiction except for the application of Royal Legislative Decree 1/2007 of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws.

Also, HISPA IMPORTACIONES DELUXE informs the consumer of its willingness to join the Online Dispute Resolution platform for any dispute that may arise in consumer matters from the time that Spain has dispute resolution bodies in accordance with the provisions of art. 14.2 of Regulation (EU) 524/2013 which is available at the following link: https://ec.europa.eu/consumers/odr/. HISPA IMPORTACIONES DELUXE shall not be liable for possible anomalies in the operation of this platform.

 

 

VIII.- Other considerations.

HISPA IMPORTACIONES DELUXE reserves the right to modify these General Conditions at any time without prejudice to the user and respecting, where appropriate, the conditions that are in force at any given time.

At any time the consumer may, where appropriate, submit their claims both by email to the following email address Customer Service Centre or in writing by addressing their complaint to the registered office of the company to the contact address.
